Indemnity Declaration

By registering for the Standard Chartered Nairobi Marathon, you make the following declarations, confirmations, and agreements. Please read this Indemnity Declaration carefully — it forms part of your entry alongside our Terms & Conditions.

Acknowledgement of Risk & Fitness

• You understand the risks of participating, including the risk of dehydration and the risk of being on a course with vehicle traffic, even where the course is regulated or policed.
• You understand that you must be, and must train to, an appropriate level of fitness to participate in the event.
• You confirm that you are physically fit and capable of participating in the event, and that you have not been advised otherwise by a qualified medical practitioner.

Waiver & Release of Liability

• For yourself and your legal representatives, you waive all claims of whatsoever nature against any and all sponsors of the event, Nairobi City County, all political entities, authorities and officials, all contractors and construction firms working on the event, all Standard Chartered Marathon Local Organising Committee persons, officials and volunteers, and all other persons and entities associated with the event — and the directors, employees, agents and representatives of any of the above — including any claims that may result from your participation, whether on account of illness, injury, death, or otherwise.

Medical Emergency Authorisation

• If you are injured, taken ill, or otherwise suffer any detriment, you irrevocably authorise the event organisers and officials to transport you to a medical facility and/or administer emergency medical treatment, and you waive all claims that might result from such transport and/or treatment, or any delay or deficiency in it.
• You agree to repay or reimburse any of your medical and emergency expenses, and authorise the organisers to incur these on your behalf. You will provide race officials with such medical data relating to you as they may reasonably request.
• Nothing in this declaration obliges the event officials, organisers, or any other person to incur any expense, or to provide any transport or treatment.

Consent to Use of Your Data

By agreeing to these terms, you consent to the use of your personal data – including contact information, images, videos, motion pictures, recordings, or any other records of this event ("information") – for any legitimate purpose, including:

• Commercial advertising by film, television, radio, print media, internet, publicity material, or any other media now existing or created in the future.
• Marketing of products offered by the Organiser and those offered by sponsors of the marathon.
• Publishing and storing race results, ranking individual participants, and keeping a historic log of this data for staging the event and for archival purposes.

You understand this information may need to be disclosed to the Organiser's affiliate companies, agents, advisors, and third-party services ("Other Parties"), who may only handle your information subject to the Organiser's instructions. Group Entries & Minors

• These terms and conditions of entry and participation, and the clauses of this indemnity, apply to all members of a group on whose behalf you are signing.
• If you have under your care or control children below 18 years of age participating in the event, you must ensure they are accompanied at all times by a responsible adult. The terms and conditions of Entry and Participation and the clauses of this indemnity apply equally to such children, and parents or guardians take full responsibility and liability for the minors participating in the event.

Declaration of Accuracy

By entering the Standard Chartered Nairobi Marathon, you declare that the date and information provided on your entry form is true and correct. By electronically submitting your entry form, you agree and confirm that you accept all terms and conditions and this waiver policy in full.
